FOREX SIMPLIFIED, LLC TERMS OF SERVICE The following terms and conditions ("Terms of Service") govern the use of the Forex Simplified LLC website, www.4xsimplified.com, all sub domain names associated with 4xsimplified.com, and any services contained within this website ("Site"). Account Terms -Subscribers must be 18 years or older to use this Service. -Subscribers must provide your legal first & last name, a valid email address, and any other pertinent information requested in order to complete the signup process. Payment & Refund Terms -A valid credit card is required for all subscription based accounts. Free accounts are not required to provide a credit card number. -The Service will be billed in advance on a monthly basis and is non-refundable. Any money back guarantee applies only on the first month and to new customers. -All credit card transactions are processed by a third-party payment processor, PayPal.com. -- Forex Simplified will NOT be responsible for any transactions and your credit card details. Please refer to the privacy policy of PayPal.com for details in this regard. Upgrading, Downgrading & Cancellation Terms -Upgrades or downgrades in plan level will be billed to subscriber credit cards at the new rate at the beginning of the next billing cycle. Due to the accounting difficulty involved with the third party processing of payments, monetary differences in the subscription plans will NOT be subject for refund. Subscribers will be solely responsible for upgrading, downgrading or cancelling your account. Privacy Policy This privacy policy describes exactly how Forex Simplified, LLC uses identifiable information regarding our customers, such as name, email address or credit card number. Primarily, we collect such information for the purpose of providing you with an outstanding experience on the Forex Simplified, LLC Service. 4xsimplified.com has created this privacy policy in order to demonstrate our firm commitment to protecting your privacy. We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. We restrict access to personal information to Forex Simplified employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. Personal Information Subscribers signing up for our service that requires registration, are asked to provide personal information including but not limited to a full legal name, email address and other personal data. If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use. If we propose to use personal information for any purposes other than those described in this Policy and/or in the specific service privacy notices, we will offer you an effective way to opt out of the use of personal information for those other purposes. We will not collect or use sensitive information for purposes other than those described in this Policy and/or in the supplementary service privacy notices, unless we have obtained your prior consent. Subscribers may decline to submit personal information to any of our services, in which case Forex Simiplified may not be able to provide those services to you. -Forex Simplified, LLC uses collected information for the following general purposes: products and services provision, billing, identification and authentication, services improvement, contact, and research. CREDIT CARD DETAILS Credit card information is not stored on Forex Simplified, LLC servers. All credit card transactions are processed by a third-party payment processor, PayPal.com and Forex Simplified, LLC is in no way responsible for any transactions and/or credit card details. Please refer to the privacy policy of PayPal.com for details. NON-DISCLOSURE OF PROPRIETARY INFORMATION Student acknowledges and understands that Forex Simplified, LLC has expended a substantial amount of time and effort, and has incurred substantial cost, in developing it’s Proprietary Information. Forex Simplified, LLC’s Proprietary Information includes, but is not limited to, The Private A-Z course, all written training materials, marketing and advertising materials and methods of operations, publications, and business practices. Forex Simplified, LLC derives economic value, both actual and potential from not having it’s Proprietary Information remains a secret. Student understands that during the subscription or any training course he/she will gain access to Forex Simplified, LLC’s Proprietary Information. While Student is certainly entitled, and in fact encouraged, to utilize all the information obtained through the subscription or the training course in pursuit of the personal goal of learning successfully to trade foreign currency contracts, Student covenants that he/she will not use said Proprietary Information for any purpose inconsistent with the terms of this Agreement. Specifically, Student agrees that he/she shall not for any reason, at any time, without the written consent of Forex Simplified, LLC, disclose to any person or entity any of Forex Simplified, LLC’s Proprietary Information. CONVENANTS NOT TO UTILIZE PROPRIETARY INFORMATION TO COMPETE WITH FOREX SIMPLIFIED, LLC Student covenants that he/she is enrolling in the subscription services for the sole purpose of becoming educated with the personal goal of learning to trade foreign currency contracts, as well as other commodity and futures contracts. Student covenants that he/she is not enrolling in the training course for reasons associated with competing with Forex Simplified, LLC’s business enterprise or otherwise obtaining Forex Simplified, LLC’s Proprietary Information for any use inconsistent with the teaching of the training courses and subscription services. Student acknowledges and agrees that Forex Simplified, LLC has a valid and protectable interest in preserving its business enterprise of offering training courses and subscription services teaching trading methodologies for trading foreign currency contracts, as well as other commodity and futures contracts. Consistent with the foregoing, Student agrees, that for a period of two (2) years after Student enrolls in Forex Simplified, LLC’s training course or subscription services Student will not to utilize Forex Simplified, LLC’s Proprietary Information, directly or indirectly, on behalf of himself or on behalf of or in conjunction with others, as principal, agent, servant, or otherwise, to engage in, or have an interest in, the same competitive line of business, or similar business enterprise, now carried on by Forex Simplified, LLC. EXTERNAL LINKS - This site may contain links to other sites. Forex Simplified, LLC is not responsible for the privacy practices or the content of these other sites. POLICY CHANGES - Forex Simplified, LLC reserves the right to periodically update this privacy policy without any prior notice. Participant agrees that anytime during the term of service or at anytime thereafter, participant will not disclose any information disclosed to them from the use of the service to any person or corporation or other entity without the written consent of Forex Simplified, LLC. Participant agrees that on behalf of or in conjunction with others will not compete with the business of the company, or have any interest in such business enterprise which shall be engaged in competition, as proprietor, partner, employee, shareholder, principal, agent, consultant, director, officer, or in any capacity or manner whatsoever, anywhere. Subscriber agrees not to lend money to any persons for the reason of creating a service that competes with the company. In the event that Forex Simplified, LLC or their representatives are required to retain an attorney to enforce this agreement, they shall be entitled to recovery of reasonable attorneys fees and all expenses associated with any litigation. The participant agrees that by entering and utilizing the services, he or she agrees and understands the above agreement, risks, and disclaimers. This statement of risk has been written for the protection of both parties. Forex Simplified, LLC, and its representatives are currently not registered with the Commodity Futures Trading Commission in any capacity, whether as a Commodity Trading Advisor or otherwise. SMS Alerts – “PRO” Members will be provided trade setups via SMS Alerts as they arise in real time.
